These Terms of Service ("Terms") govern your access to and use of launch30.com (the "Site") and any services provided by Launch30 LLC ("Launch30", "we", "our", "us"). By using our Site or services, you agree to these Terms.
1. Use of the Site
You may use the Site for personal, non-commercial informational purposes. You agree not to misuse the Site, attempt to gain unauthorized access, transmit malicious code, or interfere with its operation.
2. Consulting Services
Specific consulting engagements are governed by a separate signed Statement of Work (SOW). In case of conflict between these Terms and a SOW, the SOW controls for that engagement.
3. Fees and Payment
Fees, deliverables, and payment schedules are set forth in each SOW. Late payments may incur a 1.5% monthly finance charge to the extent permitted by law.
4. Intellectual Property
The Site's content, branding, and original work product belong to Launch30 unless otherwise stated. Upon full payment, deliverables produced specifically for a client (logos, copy, code) are assigned to that client, except for our pre-existing tools, templates, and methodologies.
5. Confidentiality
We treat client information as confidential and require our team and contractors to do the same. You agree not to publicly disclose proprietary methodologies or confidential materials we share with you.
6. No Guarantee of Results
While we work diligently to deliver excellent results, the success of a business depends on many factors outside our control. We make no guarantee of revenue, profit, or specific business outcomes.
7. Limitation of Liability
To the maximum extent permitted by law, Launch30's total liability for any claim arising from these Terms or our services is limited to the fees paid by you for the specific engagement giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
8. Indemnification
You agree to indemnify and hold harmless Launch30 from any claims, damages, or expenses arising from your misuse of the Site or breach of these Terms.
9. Termination
We may suspend or terminate your access to the Site at any time for breach of these Terms. Engagement terminations are governed by the applicable SOW.
10. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Yuma County, Arizona.
11. Changes
We may update these Terms occasionally. The "Last updated" date will reflect any changes. Continued use of the Site after a change constitutes acceptance.
